The www.bubblyfacialbar.com website (the "Site") is comprised of various web pages operated by Bubbly Facial Bar LLC ("Bubbly Facial Bar"). www.bubblyfacialbar.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of www.bubblyfacialbar.com constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference. www.bubblyfacialbar.com is an E-Commerce Site. Our website purpose is to provide educational skincare tips and to disseminate information regarding safe and effective skincare practices while also providing local facial services and retail products to the Treasure Valley.

Electronic Communications

You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications that we provide to you electronically via email and on the Site satisfy any legal requirement that such communications be in writing.

Children Under Thirteen

Bubbly Facial Bar collects personally identifiable information from children under the age of thirteen for the following reasons: We provide services for children as young as 6, and we house the information on our secure server to further serve them as they come in for future appointments. We also host events for children to learn about their skin, how to care for their skin, and how to grow into young adults who may experience skin issues that we may have solutions for. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website. If you are a parent and have questions regarding our data collection practices, please contact us using the information provided at the end of this Agreement. If you are under 18, you may use www.bubblyfacialbar.com
 only with permission of a parent or guardian.

Cancellation/Refund Policy

No refunds are provided on already paid membership services or pay-by-service charges. Retail products can be returned only if sealed, unopened, and unused. We do not accept returns or exchanges on opened products regardless of usage. We created a deposit policy to ensure that everyone respects each other's time, including those who did not get to book your selected time slot and the provider who shows up prepared to perform the service. We have a strict cancellation policy based on mutual respect for your time and our skin specialists. We charge a 50% deposit and will retain that deposit for cancellations made less than 12 hours prior to the appointment time. We will charge 100% for a no-call, no-show appointment. We assure you that we will always be on time and prepared for your appointment because we truly value you. Tardiness beyond 5 minutes for a 30-minute appointment will result in rescheduling. Tardiness beyond 10 minutes for any other appointment will result in rescheduling. We want to make the most of our time together and it takes the full appointment to do so.

International Users

The Service is controlled, operated, and administered by Bubbly Facial Bar from offices within the USA. If you access the Service from outside the USA, you are responsible for compliance with local laws. You agree not to use Bubbly Facial Bar content in any country or manner prohibited by applicable laws or regulations.

Indemnification

You agree to indemnify, defend, and hold harmless Bubbly Facial Bar, its officers, directors, employees, agents, and third parties from any losses, costs, liabilities, and expenses, including reasonable attorney's fees, arising out of your use of or inability to use the Site or services, any postings made by you, your violation of these Terms, violation of third-party rights, or violation of any laws or regulations. Bubbly Facial Bar reserves the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate fully in asserting any defenses.

Arbitration

If the parties are unable to resolve disputes arising out of these Terms, such disputes shall be resolved by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator administered by the American Arbitration Association or a similar service agreed upon by the parties. The arbitrator’s award shall be final and judgment may be entered in any court with jurisdiction. The prevailing party in any arbitration or legal proceeding shall be entitled to recover reasonable attorney’s fees and costs. The Federal Arbitration Act governs interpretation and enforcement of this provision, and the arbitration clause survives termination of these Terms.

Class Action Waiver

Any arbitration under these Terms will occur on an individual basis; class or representative actions are not permitted. The parties agree that claims may be brought only in each party’s individual capacity and not as part of any class, collective, or representative proceeding. The arbitrator may not consolidate multiple claims or preside over any representative or class proceeding unless both parties agree otherwise.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. BUBBLY FACIAL BAR LLC AND/OR ITS SUPPLIERS MAY MAKE CHANGES TO THE SITE AT ANY TIME. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. BUBBLY FACIAL BAR LLC AND/OR ITS SUPPLIERS DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUBBLY FACIAL BAR LLC AND/OR ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO USE OF THE SITE, INCLUDING LOSS OF USE, DATA, OR PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF DAMAGES. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE OR THESE TERMS, YOUR SOLE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination/Access Restriction

Bubbly Facial Bar reserves the right to terminate your access to the Site at any time without notice. This agreement is governed by the laws of the State of Idaho, and you consent to exclusive jurisdiction and venue in Idaho courts for disputes arising from use of the Site. Use of the Site is unauthorized in jurisdictions that do not give effect to all provisions of these Terms. No joint venture, partnership, employment, or agency relationship exists between you and Bubbly Facial Bar as a result of this agreement. If any provision is deemed invalid or unenforceable, the remainder shall continue in effect. This agreement constitutes the entire agreement between the user and Bubbly Facial Bar regarding the Site and supersedes all prior communications. It is the express wish of the parties that this agreement and related documents be written in English.

Changes to Terms
